Gov't 'comfortable' with conclusion of 28th formal talks with MILF -- Leonen

Kuala Lumpur, May 30 - Government of the Philippines (GPH) peace panel chair Marvic Leonen said that he is "comfortable" with how this month's round of talks with the Moro Islamic Liberation Front (MILF) ended.

The three-day 28th formal exploratory talks between the GPH and the MILF officially concluded today with both sides agreeing to go back to their principals and further refine their respective positions on the substantive agenda.

A month after signing the landmark Decision Points on Principles document which both parties view as a guide to the continuing discussions on the substantive aspects of the negotiations, both parties went back to the Malaysian capital to explore each other's positions on wealth-sharing, power-sharing, governance, transition roadmap and normalization. These discussions shall serve as inputs to the peace pact which both parties hope to sign soon.

"There were highs and lows in our discussions," GPH panel member Miriam Coronel-Ferrer said, "but I'd like to believe that we were able to share each other's bottomlines and explore different possibilities."
For his part, Leonen said that "the talks have been difficult but we were able to build on what has been achieved in last month's round (of talks)."

Leonen further emphasized that what's important for the government is that it was able to bring to the table the results of the consultations conducted with the different stakeholders in the Mindanao peace process.
Meanwhile, the panel will continue to engage national and local officials, civil society groups, communities, experts and other stakeholders to gain their insights on the government's position.

Aside from Leonen and Ferrer, the government peace panel is composed of Presidential Assistant for Muslim Concerns Yasmin Busran-Lao, former agriculture secretary Senen Bacani and Dr. Hamid Barra.

Joining the panel in this round of talks are North Cotabato 1st district Rep. Jesus Sacdalan, Maguindanao Gov. Esmael "Toto" Mangudadatu, Basilan Gov. Jum Akbar, Sulu Gov. Abdusakur Tan, Tawi-Tawi Gov. Sadikul Sahali and Lanao del Sur Gov. Mamintal Adiong who served as consultants and observers to the negotiations. #

CPP congratulates Front 88 for Agusan raid and rescue of six minors; condemns AFP for arming minors

The Communist Party of the Philippines (CPP) today congratulated the New People's Army (NPA) Front 88 operations command for successfully carrying out a raid of three armed detachments of the Armed Forces of the Philippines (AFP) in Sitio Tambo, Barangay Binikalan, San Luis, Agusan del Sur that resulted in the rescue of at least six minors ranging from 12 to 16 years old who were conscripted as CAFGU members by the AFP.

In a radio interview, National Democratic Front of the Philippines (NDFP-Mindanao) spokesman Jorge Madlos ("Ka Oris") said a company of NPA Red fighters carried out the raid before 4:30 this morning and succesfully overran the detachments being manned by CAFGU personnel under the Philippine Army's 4th ID. The NPA has been receiving complaints from local residents against abuses being carried out by Army soldiers and CAFGU personnel in the San Luis detachment.

The NPA unit seized at least 18 firearms including one M-16 rifle, three M-14 rifles, 12 M-1 Garand rifles, one carbine, one 9mm pistol, several magazines and bullets. Unfortunately, at least one of the minors was hit in the neck after he engaged in a firefight with the NPA fighters. The assistant commanding officer of the CAFGU unit and his civilian girlfriend were also wounded. The commanding officer immediately fled when the firefight started.

After extending basic emergency care, the NPA left the six minors to the responsibility of the local community and urged them to oppose the AFP's policy of recruitment of minors in accordance with the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) and international prohibitions.

The CPP condemned the AFP for recruiting minors as armed CAFGU personnel. "The AFP continues to recruit, arm and assign minors in dangerous situations in outright violation and direct contempt of the CARHRIHL, the International Convention on the Rights of the Child and protocols of international humanitarian law."

"In coordination with international and local children's rights advocates, the NDFP-Mindanao and other interested parties can initiate a complaint before the CARHRIHL Joint Monitoring Committee, appropriate international bodies and other agencies against the AFP and the Aquino regime for violation of the CARHRIHL and international statutes prohibiting the recruitment, training and arming of children as armed soldiers," said the CPP.

The CPP added: "As the leading authority in Mindanao, the NDFP-Mindanao can receive and prepare all the necessary details concerning the case of the six minors recruited as child soldiers by the AFP, even as the identity and rights of the children against undue public scrutiny and attention are respected."

"The recruitment, training and arming of minors as CAFGU and Army personnel expose the empty human rights rhetoric of the Aquino regime and the AFP under its Oplan Bayanihan war of suppression," said the CPP.

"The AFP is having a hard time in recruiting new personnel. CAFGU detachments of the AFP are often undermanned. Units of the fascist Philippine Army have resorted to the forced conscription of local community youth and children to make up for the lack of personnel," added the CPP.

HR group says Aquino fails in human rights vow


May 26, 2012 News: The Human Rights Watch (HRW), a New York based human rights monitor, has said that President Benigno Aquino III failed to deliver on his campaign pledges to prosecute members of security forces implicated in killings and disappearances.

According to its latest monitor and documentation, HRW has listed seven cases of extrajudicial killings and three cases of disappearances—all with evidence pointing to military involvement—since President Aquino took office on June 30, 2010.


But there had been no punishment or prosecution in any of the cases, it said in a statement.


"The administration . . . has failed to take significant measures to prosecute members of the military, police and militias implicated in extrajudicial killings, torture and enforced disappearances," HRW added.


The HRW is an international non-governmental organization that conducts research and advocacy on human rights. Its headquarters are in New York City and it has offices in Berlin, Beirut, Brussels, Chicago, Geneva, Johannesburg, London, Los Angeles, Moscow, Paris, San Francisco, Tokyo, Toronto, and Washington.


The George Soros Open Society Foundation is the primary donor of the Human Rights Watch, contributing $100 Million of $128 Million of contributions and grants received by the HRW in the 2011 financial year.


In a related development, the Manila Times quoted Commission on Human Rights Chairman Loretta Rosales as saying that she agreed with many of the US group's complaints.


"At this point, we have a lot of lip service. People are not convinced and I don't blame them," she said during an interview with ABS-CBN television.


"There is no effective reduction [of abuses]," Rosales added.

Ulama assured of gov’t sincerity in MILF peace talks

Marawi City, May 25 – A group of Ulama or Islamic scholars received assurance that the Government of the Philippines (GPH) has sincere intentions in the current negotiations with the Moro Islamic Liberation Front (MILF).

GPH Panel member Dr. Hamid A. Barra on Tuesday told members of the Philippine Usrah Foundation, Inc. (Usrah) in this city that on the part of government, “sincerity is out of the question because the GPH has always been sincere in the negotiations.”

Barra, held this consultation with the Islamic scholars ahead of the next round of the GPH-MILF formal exploratory talks later this month. Barra is himself an Aleem, an Islamic scholar dedicated to studying Islamic history, laws, and way of life. Ulama is the plural form of Aleem.

The Islamic forum was attended by Ulama from the municipalities of Ramain, Maranto, Masiw and Bacolod in Lanao del Sur. Islamic educators from Mindanao State University-Marawi (MSU), Jamiatu Marawi Al- Islamia Foundation, and Qualisi International School were also in attendance.


Ulama bid support

Dean Talib Benito, head of the King Faisal Center for Islamic, Arabic and Asian Studies in MSU, raised the importance of GPH consultations to the Ulama in Marawi.

“This consultation is important because it determines the valid opinions of the Ulama in Marawi with regard to the current GPH-MILF negotiations. We all hope for the speedy signing of a peace agreement between the two parties before the 2013 elections,” he said in an interview.

Barra provided pertinent information to the forum participants particularly on the recent developments in the GPH-MILF talks wherein both parties signed the Decision Points on Principles last April 24 in Kuala Lumpur.

The document contains 10 mutually identified standpoints that will guide the succeeding round of negotiations toward a final peace pact.


Concerns and suggestions

Aleem Abdul Salam Disomimba urged other Usrah members to get involved in the peace process.
“As Islamic educators, each of us should share our views with respect to the negotiations between the government of the Philippines and the Moro Islamic Liberation Front. We know that our contribution is not limited,” he said. “What then can we suggest to the GPH and MILF panels?”

In response to this call, Judge Aboali Cali of the Regional Trial Court Shari’ah suggested the creation of a national and local contact group which will raise valid concerns and suggestions of the Bangsamoro groups in the area to the GPH and MILF panels.

He said he hopes for the panels to accommodate his proposal but stressed that he highly “recognizes the effort and help being provided (to the negotiations) by the International Contact Group (ICG) and the International Monitoring Team (IMT).”

The ICG, which is composed of members from international government and non-government groups, is mandated to exert the necessary leverage and assistance towards sustaining the trust and confidence of both sides at the negotiating table. On the other hand, the IMT is a group that monitors the ceasefire, civilian protection component, rehabilitation and development, and socio-economic agreements between the government and the MILF. It is comprised of representatives from Malaysia, Brunei, Libya, Japan, Norway and the European Union.

Meanwhile, Aleem Ustadj Omar raised the issue on the alleged delaying tactics happening in the talks. He said that “[he] knows from the past and up until now, that there are delaying tactics happening in the negotiations.”

However, Barra countered this allegation and reiterated his assurance that the GPH panel is sincere in its efforts to craft an agreement that will solve the Bangsamoro problem.

He then welcomed all the raised suggestions and concerns and promised to relay these to the GPH panel before the next round of talks.

The GPH and MILF are expected to meet anew later this month to discuss thoroughly the substantive issues in the negotiations. #

Moro leadership institute to conduct training on human rights


May 20, 2012 News: The Bangsamoro Leadership and Management Institute (BLMI) will conduct three-day training on human rights (HR) and International Humanitarian Law (IHL) on May 27-29, 2012.

Dr. Tomanda Antok, Chairman of the BLMI Steering Committee, told Luwaran that the training will be funded and supported by the Non-Violent Peaceforce (NVPF).
The NVPF is a nonpartisan unarmed peacekeeping organization that works to protect civilians and reduce violence in areas affected by armed conflict. In partnership with local groups, Nonviolent Peaceforce members aim to apply proven strategies to protect threatened individuals and communities, deter violence, and help create space for local civil society actors to build sustainable peace.
The NVPF is currently a member of the Civilian Protection Component (CPC) of the International Monitoring Team (IMT) which is monitoring the ceasefire between the MILF and the Philippine Government.

Fifteen (15) participants who possess strong personality from the different provinces of Mindanao shall participate in this first of its kind training workshop.

Resource persons will come from the International Pool of Experts in International Laws.

The training aims to produce young men and women who would be responsible to advocate human rights in the Asia Pacific Region.

However, Tomanda did not disclose whether the newly constructed 2-storey building of the BLMI will be the venue of the training.

The new edifice was built and funded by the Embassy of Japan under the Grant Assistance for Grassroots Human Security Projects (GGP) for fiscal year 2010. Earlier, the Asia Foundation (TAF), the United States Aid for International Development (USAID), and the Development Academy of the Philippines (DAP) have extended miscellaneous aids including financial and technical to jumpstart its operation. The Philippine government through its peace panel had also voluntarily given P6 million, the main bulk was handed to the MILF peace panel after the Murad-Aquino meeting in Tokyo, Japan on August 4, 2011.

Malawakan at malupit na kampanya ng pananakot at pandarahas ang kasalukuyang nananalasa sa mamamayan ng South Quezon-Bondoc Peninsula (SQ-BP) sa pagpapatindi ng digmang mapanupil na Oplan Bayanihan ng rehimeng US-Aquino.

Isa na sa pinakamasisinsin sa kasaysayan ng mga kampanyang pagkubkob at panunupil ng kaaway ang pakat ng pasistang mga pwersa sa SQ-BP. Umaabot na sa walong batalyon ng mga pwersang panagupa ang nakakonsentra sa kabuuang 22 bayan, o humigit-kumulang 200 pasistang pwersa bawat bayan. Kabilang dito ang buong batalyon ng 74th IB, ang 85th IB, 76th IB at Special Forces Battalion, ang 416th Public Safety Management Company (PSMC) at ang 417th PSMC  at tatlo't kalahating batalyon ng mga pwersa ng CAFGU sa ilalim ng pangangasiwa ng 59th IB. Bukod pa rito ang mga pwersa ng Philippine National Police na nakadestino sa iba't ibang bayan sa SQ-BP.

Nanghahalihaw sa masa ang mga pasistang pwersa. Pinaiiral nila ang kapangyarihan at batas ng militar. "Nakasentro sa tao" diumano ang taktika sa ilalim ng Oplan Bayanihan na kanilang ginagamit, subalit kaliwa't kanan ang mga paglabag sa karapatang-tao.

Matagalang nagbabase sa mga baryo ang mga laking-iskwad na pangkat ng mga armadong sundalong tinaguriang "peace and development team." Ginagamit nilang base ang mga bahay ng mga mUmaabot sa anim na buwan na ginagamit nilang base ang bahay ng mga magsasaka sa mahigit 50 baryo. Umaabot sa tatlo hanggang anim na buwan silang tumitira sa mga bahay ng masa. Animo'y mga palamuning baboy ang mga pasistang sundalo na sa mas malaking panaho'y naglalasing, nagsusugal at nagte-text. Salot sila sa kabuhayan ng masa. Ginagamit din nilang base ang mga sentro ng barangay at iba pang pampublikong istruktura.

Inoobliga nila ang lahat na dumalo sa ipinatatawag nilang mga pulong. Isinasailalim nila ang mga lokal na residente sa interogasyon sa tabing "sensus." Ipinatatawag ang sinumang nais nilang imbestigahan. Pinag-iinitan nila ang mga magsasakang aktibo sa mga pakikibakang masa. Pinararatangan silang mga kasapi ng rebolusyonaryong organisasyong masa o tagasuporta ng armadong rebolusyon at isinasailalim sa walang katapusang panggigipit at pananakot upang mapilit na makipagtulungan sa militar at "malinis ang rekord." Ang hindi makikipagtulungan ay napipilitang lumisan sa lugar upang makaiwas sa banta sa kanilang buhay.

Hindi mapagtakpan ang pasistang pangil ng Oplan Bayanihan sa SQ-BP. Mula nang magsimula ang pananalasa ng Oplan Bayanihan sa SQ-BP, naisadokumento na ang mahigit isandaang kaso ng paglabag sa karapatang-tao, kabilang ang mga paglapastangan sa karapatan ng mga bata, pamamaslang at pagdukot. Kaliwa't kanan ang mga kaso ng iligal na panghahalughog at detensyon.

Pinaiigting ang Oplan Bayanihan sa SQ-BP alinsunod sa layunin ng rehimeng US-Aquino at ng AFP na "linisin ng NPA" ang lugar sa katapusan ng 2012. Nais ni Aquino na itanghal bilang "tropeyo" ang SQ-BP na bantog sa mahabang kasaysayan ng mga pakikibakang magsasaka at armadong rebolusyon.

Gayunman, lumilikha ng di maiiwasang kontradiksyon ang rehimeng US-Aquino. Sa pagpapatindi nito ng kampanyang panunupil, lalo lamang nitong itinutulak ang mamamayan sa landas ng mga pakikibakang masa upang labanan ang pang-aapi, igiit ang kanilang mga kahilingan para sa tunay na reporma sa lupa at wakasan ang pyudal na pagsasamantala. Sa pagpapatindi ng pandarahas, lalo lamang nitong pinatitingkad sa kamalayan ng mamamayan ang pangangailangang humawak ng sandata at lumaban.

Sa harap ng matinding brutalidad ng pasistang armadong pwersa ng rehimeng US-Aquino, nananawagan ang Partido Komunista ng Pilipinas sa mamamayan ng SQ-BP, sa mga kinauukulang yunit ng BHB sa larangan at buong rehiyon ng South Tagalog, sa lahat ng lokal na sangay ng PKP at mga rebolusyonaryong organisasyong masa na maagap at ubos-kayang kumilos upang ilantad, batikusin, labanan at biguin ang Oplan Bayanihan. Sa mga darating na buwan, buong tapang at matalinong kumilos, pasiglahin ang mga pakikibakang masa at paigtingin ang mga taktikal na opensiba.

Ang malawakang militarisasyon sa SQ-BP ay nagbubukas ng maraming pagkakataon para magtipon ng malalaking tagumpay at sumulong nang malaki ang rebolusyonaryong kilusan.

Dapat maglunsad ang lokal na mga yunit BHB ng papalawak, paparami at papatinding mga taktikal na opensiba sa mga darating na buwan. Parusahan ang mga pasistang nandarahas sa mamamayan. Patatagin ang determinasyon at ibayong itaas ang kakayahan ng mga yunit ng BHB sa SQ-BP. Magpakahusay sa pagsasamantala sa paborableng tereyn, sa superyoridad ng mga taktikang gerilya at malalim na suportang masa upang pinsalain ang kaaway, kunin ang kanilang mga sandata at armasan ang paparami pang mga Pulang mandirigma.

Napakaraming pagkakataon para maglunsad ng mga taktikal na opensiba na tiyak na maipagtatagumpay. Dapat mahigpit na subaybayan ang mga kilos ng kaaway upang matukoy ang iba't ibang bahagi ng manipis na nakakalat na mga yunit ng AFP, ang kanilang mga linya ng suplay at iba pang mahinang target. Itaas ang opensibang postura at ang kakayahan sa mabilis at lihim na pagkilos upang samantalahin ang ibinubukas na napakaraming pagkakataon na makapaglunsad ng mga armadong pagsalakay laban sa pasistang kaaway.

Ang mga yunit ng BHB sa iba pang bahagi ng rehiyon ng South Tagalog ay dapat makapaglunsad ng napapanahong mga taktikal na opensiba alinsunod sa pagbasa at pagsubaybay sa pakat at kilos ng AFP. Dapat makapaglunsad rin ang BHB sa kanugnog na bahagi ng rehiyong Bicol ng mga taktikal na opensiba upang puwersahin ang kaaway na maglipat-lipat ng mga yunit nitong nakakonsentra sa SQ-BP. Sa gayong paraan, lalong kakayanin ng mga lokal na yunit na BHB sa SQ-BP na makapagmaniobra at magdulot ng papalaking mga bigwas sa kaaway.

Pag-ibayuhin ang tapang ng mamamayan na labanan ang kampanyang panunupil ng rehimeng US-Aquino. Pandayin ang kanilang militansya para labanan ang panghahalihaw, pananakot, panlilinlang at pandarahas laban sa kanila ng mga pasistang sundalo at iba pang armadong tauhan ng reaksyunaryong rehimen. Ilunsad ang iba't ibang aksyong masa kabilang ang sama-samang ebakwasyon at pagkilos sa mga sentrong bayan bilang pagprotesta sa presensya at pagbabase ng mga sundalo sa kanilang mga bahay at baryo.

Kaalinsabay ay palaganapin at paalingawngawin ang sigaw para sa tunay na reporma sa lupa at ang rebolusyong agraryo. Ang pakikibakang anti-pasista ay palalalimin at patatatagin ng pagpapasigla ng mga pakikibakang masa para ibaba ang upa sa lupa, itaas ang sahod ng mga manggagawang bukid, pawiin ang usura at ipatupad ang makatwirang pagpepresyo sa kanilang mga produkto.

Dapat matatag na kumilos ang mga rebolusyonaryong organisasyong masa at lokal na mga sangay at grupo ng Partido sa SQ-BP laban sa pananalasa ng Oplan Bayanihan. Palakasin ang pakikidigmang masa. Mabilis na paramihin ang mga komite sa depensa at mga milisyang bayan. Palakasin ang kilusang paniniktik sa kaaway. Palakasin ang kilusang lihim. Pakawalan ang inisyatiba at pagkamapanlikha ng masa sa paggamit ng iba't ibang mga taktika para makaagaw ng armas at makapaglunsad ng iba't ibang mga pagsalakay sa kaaway. Pasiglahin ang rekrutment sa BHB.

Buuin ang malawak na nagkakaisang prente para suportahan ang mamamayan ng SQ-BP laban sa Oplan Bayanihan. Palakasin ang kilusan laban sa militarisasyon at para sa pagtataguyod ng karapatang-tao. Hikayatin ang kaliwa't kanang imbestigasyon sa dumaraming kaso ng paglapastangan sa karapatang-tao, laluna sa karapatan at kagalingan ng mga bata. Ilantad at sampahan ng mga kaso ang mga kriminal na upisyal at tauhan ng AFP.

Paalingawngawin sa iba't ibang sulok ng mundo ang sigaw para sa katarungan ng mamamayan ng SQ-BP. Pukawin ang simpatya at protesta ng mga Pilipino at mamamayan sa ibayong dagat. Palakasin ang sigaw para panagutin ang mga upisyal na nasa likod ng mga paglabag sa karapatang-tao at internasyunal na makataong batas.

Matuto sa karanasan ng mamamayan at mga rebolusyonaryong pwersa sa ibang mga rehiyon upang kamtin ang malalaking tagumpay sa mga darating na buwan laban sa Oplan Bayanihan sa SQ-BP. Bukas ngayon ang pagkakataon na mapagpasyang idiskaril ang kampanyang panunupil ng rehimeng US-Aquino sa SQ-BP, bigyang-daan ang mabilis na pagsulong ng mga demokratikong pakikibaka ng masang magsasaka at ang paglakas ng armadong rebolusyon.

Katulad ng ipinakikitang brutalidad sa South Quezon-Bondoc Peninsula, pinatutunayan ni Aquino na ang Oplan Bayanihan ay walang pinagkaiba, kundi mas malupit pa kumpara sa nakaraan. Malinaw na nalalantad sa SQ-BP na walang saysay ang bukambibig ng AFP na "pagtataguyod sa karapatang-tao" at "pagsusulong ng kapayapaan."

Batid ng mamamayang Pilipino na ang digmang panunupil na Oplan Bayanihan ng rehimeng US-Aquino ay digma ng pagtatanggol sa bulok na mapang-api at mapagsamantalang sistema. Gaano pa man kalupit, tiyak na mabibigo ito sa harap ng tapang at militansya ng mamamayan at determinasyon nilang sumulong sa landas ng pakikibakang masa at armadong rebolusyon.

Manila, May 18 – The Office of the Presidential Adviser on the Peace Process (OPAPP) on Thursday said that it will immediately study the findings of the fact-finding mission (FFM) undertaken by peasant groups on the atrocities allegedly perpetrated by members of the Rebolusyonaryong Partido ng Manggagawa-Pilipinas/Revolutionary Proletarian Army/Alex Boncayao Brigade (RPM-P/RPA/ABB), while assuring aggrieved parties that justice will be pursued.


In a dialogue with representatives of the Kilusang Magbubukid ng Pilipinas (KMP) and the National Federation of Sugar Workers (NFSW) as well as victims at the OPAPP headquarters in Pasig City, Undersecretary Luisito Montalbo thanked the groups “for bringing the results of their investigation to their attention.”

“The GPH-RPM-P/RPA/ABB peace track will need all the feedback we can get from the ground. We want to put a proper closure to this peace track," Montalbo said.

Montalbo assured the group that the closure of the peace process currently being pursued by the government with the RPM-P/RPA/ABB is intended to bind the rebel group to commit to peace and ensure their accountability to the rule of law.

He also said that the rebel group is aware of this and has been working with the government in the profiling of its members and inventory of firearms in preparation for disarmament.
He also urged the victims and the KMP and NFSW to file the necessary cases to the courts for proper action, stressing that the agency will coordinate with the Department of Justice, the Department of Agrarian Reform, and the Commission on Human Rights to help the aggrieved seek justice as soon as it receives copies of affidavits and other pertinent documents from the complainants.

No fund release yet

Meanwhile, Montalbo shed light on a news report that the P-Noy administration has already released funds to the RPM-P/RPA/ABB.

“The funds are intended for development projects in the communities and will be coursed through appropriate government agencies that will implement the projects,” he stated, adding that OPAPP has only signed a Memorandum of Agreement with the provincial local government units but no release was made yet pending the signing of a closure agreement.

    CPP condemns rearrest of NDF peace consultant

    The Communist Party of the Philippines (CPP) condemned the rearrest last May 2 of Jaime Soledad, consultant of the National Democratic Front of the Philippines (NDFP) in the peace negotiations. Soledad, 63, was arrested at his house in Inopacan, Leyte, on trumped-up charges of murder.

    "NDFP Consultant Jaime Soledad's rearrest less than a year since he was released under the auspices of peace negotiations smacks of the highest level of treachery by the Aquino regime," said the CPP. Soledad was first arrested in March 2008 in Cavite and detained for three years before being released in July 2011 as part of the Aquino government's compliance with its obligations under the Joint Agreement on Safety and Immunity Guarantees (JASIG).

    "In rearresting Soledad, the Aquino regime has violated his rights stipulated in the JASIG against the arrest and detention of document holders," pointed out the CPP.

    "The Aquino regime continues to make the resumption of peace negotiations difficult as it persists in violating the JASIG," said the CPP. A little over a month ago, the Aquino government arrested community organizer Reynante Gamara who is also an NDFP consultant in the peace talks.

    With the release today, May 15, of PO2 Faizahl M. Juhaili (Serial #056452) of the PNP somewhere in Bayog, Zamboanga del Sur, the NDFP-Mindanao commends the New People’s Army in the Western Mindanao Region (NPA-WMR) for demonstrating strict adherence to international war protocols. The Red fighters in WMR, under the absolute leadership of the Communist Party, have once again exhibited not only its capability in combat but also its maturity in carrying out the special task of handling prisoners of war. 
     
    PO2 Juhaili became a captive of war consequential to the April 9, 2012 NPA raid on the Municipal PNP Headquarters in Tigbao, Zamboanga del Sur, and placed him under the disposition of the unit of revolutionary people’s government.  Under the NPA’s custody, PO2 Juhaili was afforded his rights vested in him as a prisoner of war, and, in being such, was subjected to a series of investigations carried out by the NPA who meticulously abided by the rules stipulated in the NPA 8-Points of Attention, the CARHR-IHL, and international laws of war. 

    The revolutionary political authority in the area reported that the investigation on PO2 Juhaili yielded no evidence to prove that he committed grave crimes against the people except that he only acted according to his duty as a police officer.  At the same time, there were no formal charges filed against him to the court of the people’s democratic government.  Therefore, there was no material basis anymore for his continued detention, warranting his release. While in custody, he cooperated well with and displayed a good attitude towards the members of the NPA’s custodial unit. Apart from these, PO2 Juhaili, already in his 50s and has 7 children, is also being released on humanitarian grounds in response to the plea of his family, relatives and friends for his immediate safe release.

    With this, we extend our red salute to the NPA unit in the Western Mindanao Region for adeptly executing the raid on the PNP Headquarters in Tibao, Zamboanga del Sur without a firefight and for the correct handling and safe release of the POW PO2 Faizahl M. Juhaili. During combat situations, in order to avert the unnecessary loss of lives, we ask the combatants from the opposite side of the armed conflict to desist from any attempt to resist when your opportunity to fight back is nil in order, especially so that you are only fighting as mercenary pawns defending the interest of plundering mining companies like the Toronto Ventures Inc. (TVI) and other vested interests of the ruling class that pay you with people’s taxes.   You have our assurance that we will respect your rights as hors d’ combat once you surrender to us in the course of any battle. 

    Moreover, we appeal to the AFP, PNP and other state armed apparatus to completely desist from torturing or, worse, from arbitrarily executing any member of the revolutionary movement whom you have seized, and to strictly abide by the Comprehensive Agreement on the Respect for Human Rights and the International Humanitarian Law and International Laws of War

    Finally, congratulations to PO2 Juhaili for regaining his freedom. We hope 
    that his newly reclaimed freedom will not be used to once again promote the interest of oppressive, exploitative and destructive large-scale foreign mining, big drug syndicates and of other criminal and anti-people entities.#
